Wedding Terms & Conditions
These Terms & Conditions apply to all photography, videography, and related services provided by JPB Media Productions CC (“The Service Provider”).
By confirming a booking and/or making payment, the Client acknowledges that they have read, understood, and accepted the Terms & Conditions below.
1. BOOKINGS & PAYMENTS
1.1 A 35% non-refundable booking fee secures the wedding date.
1.2 The remaining balance is due 7 days before the wedding.
1.3 No images or videos will be released until full payment is received.
1.4 All bank charges are the Client’s responsibility.
2. CANCELLATION & POSTPHONEMENT
2.1 The booking fee is strictly non-refundable and applies to the specific wedding date originally booked by the Client. The booking fee covers the reservation and exclusive allocation of the date, administration, communication, meetings, planning, preparation, scheduling, and the potential loss of other bookings declined for the reserved date.
2.2 In the event of cancellation by the Client, the following cancellation terms apply:
- 90–60 days before the wedding: 50% of the remaining balance payable
- 60–30 days before the wedding: 80% of the remaining balance payable
- 30 days or less before the wedding: 100% of the outstanding balance payable
2.3 Date changes and postponements are subject to availability and are treated as a new date reservation. As the original booking fee applies only to the original reserved wedding date, a new non-refundable booking fee will be required to secure the new date.
2.4 If the Service Provider is unavailable for the requested new date, the postponement will be treated as a cancellation of the original booking and the applicable cancellation terms will apply.
3. COPYRIGHT & USAGE RIGHTS
3.1 All copyright, creative rights, and ownership of images and video content remain the property of the Service Provider.
3.2 The Client receives a personal-use licence allowing them to share, print, and view their final delivered photographs and videos.
3.3 The Client may not, without written permission from the Service Provider:
- Sell or commercially license any content
- Alter, edit, apply filters, or modify delivered photographs/videos
- Re-edit wedding films or create alternative versions
- Use AI tools, AI software, or automated editing platforms to alter, enhance, manipulate, recreate, or change the delivered photographs/videos
- Remove watermarks, branding, metadata, or copyright information where applicable
- Provide RAW footage or source files to third parties for editing
3.4 The Service Provider reserves the right to use selected photographs and videos for portfolio, website, social media, advertising, competitions, and promotional purposes.
3.5 Should the Client require privacy or non-publication of their wedding content, this must be requested and agreed upon in writing before the wedding date.
3.6 AI Usage & Image Integrity
The Client acknowledges that the final delivered photographs and films represent the completed creative work and style of the Service Provider.
Any AI-generated alterations, including but not limited to changing appearances, replacing backgrounds, altering colours, modifying people, applying AI filters, extending images, or recreating content, are not permitted without written approval.
This ensures that all published or shared work remains an accurate representation of the Service Provider’s brand, quality standards, and artistic style.
4. RAW FOOTAGE & DATA STORAGE
4.1 RAW footage, RAW photographs, project files, and editing timelines are not included as part of any package.
4.2 RAW footage, RAW photographs, project files, and editing timelines remain the exclusive property of the Service Provider and are not available for purchase, release, transfer, or delivery to the Client. Only the final edited photographs and films selected and produced by the Service Provider form part of the agreed deliverables.
4.3 Final edited galleries and films are delivered digitally.
4.4 Download links of final deliverables remain active for 14 days after delivery. The Client is responsible for downloading and creating personal backups.
4.5 Internal RAW footage, working files, timelines, and backups are stored for a maximum period of 6 months after the wedding.
4.6 After 6 months, all RAW footage and project files may be permanently deleted. Retrieval after deletion is not possible.
5. WEDDING DAY COVERAGE & ASSIGNED TEAM
5.1 The Service Provider will assign professional team members to capture the wedding day based on the selected package, requirements, and availability.
5.2 While specific photographers, videographers, or founders may be requested, the booking is made with JPB Media Productions CC a company and not with any specific individual unless agreed upon in writing.
5.3 The Service Provider reserves the right to allocate trusted photographers, videographers, assistants, or associate team members who meet the company’s quality standards and creative approach.
5.4 All editing, final selection, quality control, and delivery will remain under the standards and creative direction of JPB Media Productions CC.
5.5 The Service Provider will follow the agreed timeline and schedule as far as reasonably possible.
5.6 The Service Provider cannot be held responsible for missed coverage due to:
- Venue or church restrictions
- Guests blocking or interfering with shots
- Delays or changes to the wedding programme
- Smoke, lasers, or technical interference from third parties
5.7 Drone footage is subject to weather conditions, location permissions, airspace regulations, and safety considerations.
5.8 Drone services are quoted separately using licensed drone operators, unless specifically included in the selected package.
6. DELIVERABLES & TURNAROUND
6.1 Standard delivery timeframes after the wedding date:
- Photos: 8–12 weeks
- Films: 8–12 weeks
6.2 Delivery times may vary during peak wedding seasons, depending on workload and production schedules.
6.3 Faster delivery timelines are only applicable if a priority/rush delivery add-on was booked, confirmed, and paid for prior to delivery. Rush delivery requests are subject to availability and additional charges.
6.4 One revision round is included for the final wedding film. This revision is limited to minor adjustments such as clip replacements, minor sequence adjustments, or correction of errors where possible.
6.5 A revision does not include a complete re-edit, change of creative direction, change of editing style, new storyline, full music replacement, or recreation of the wedding film.
6.6 Additional revision requests, major creative changes, or changes outside the included revision round may result in additional editing fees.
7. LIABILITY
7.1 Liability is limited to the portion of services affected.
7.2 The Service Provider is not responsible for:
- loss of footage due to venue restrictions or interference, memory card failure, hard drive corruption, theft, and equipment failure.
- reputational, emotional, or consequential damages
7.3 A replacement member/production team will be arranged in case of severe illness/injury where possible.
8. TRAVEL & ACCOMMODATION
8.1 Travel applies outside 100 km from Pretoria.
8.2 Travel outside 100 km will be charged at AA rates.
8.3 Accommodation outside 100 km will be for the Client’s account.
8.4 Accommodation Guidelines:
- 1-night stay: R1,200
- 2-night stay: R2,000
8.5 Meals must be provided for all crew members working more than 6 hours, and are not optional.
8.6 Due to the long duration of wedding coverage, reasonable breaks apply during the day for crew members, including time to eat and refresh, similar to a normal working day.
8.7 Meal and break times should be considered when planning the wedding timeline. Where possible, crew meals should be scheduled during guest meal times or periods where no important moments, speeches, formalities, or key events are taking place.
8.8 The Service Provider cannot be held responsible for missed coverage if scheduled formalities or important moments take place during agreed meal or break periods.
9. MUSIC RIGHTS
9.1 All music is legally licensed under the Service Provider’s Business Licence.
9.2 Commercial radio songs, copyrighted music, or any specific music requested by the Client cannot be used unless the Client obtains and provides the correct written licensing and usage permissions to the Service Provider.
The Client accepts full responsibility for any requested music supplied by them, including all licensing requirements, copyright permissions, claims, restrictions, or publishing limitations that may arise from the use of such music.
9.3 Music selection forms part of the creative editing process.
10. FORCE MAJEURE (ACT OF GOD)
The Service Provider cannot be held responsible for circumstances outside reasonable control, including but not limited to:
- Severe illness or injury
- Extreme weather/ Natural disasters
- Strikes or unrest
- Venue closure or restrictions
- Power failures/load shedding
- Government restrictions
Where possible, the Service Provider will make reasonable efforts to arrange suitable alternative solutions in accordance with these Terms & Conditions. However, alternative arrangements cannot be guaranteed and remain subject to availability and the circumstances of the event.
11. GUEST INTERFERENCE & EQUIPMENT DAMAGE
11.1 The Service Provider will make every reasonable effort to capture all important moments throughout the wedding day.
11.2 The Service Provider cannot be held responsible for missed photographs, video footage, or moments caused by guests, suppliers, venue restrictions, or any third-party interference, including but not limited to blocked views, restricted access, or interruptions during key moments.
11.3 The Service provider acknowledges that professional camera, video, audio, lighting, and related equipment will be present throughout the event.
11.4 Should any equipment belonging to the Service Provider be damaged, lost, or interfered with due to the actions of wedding guests, attendees, or suppliers appointed by the Client, the Client will be held responsible for the repair or replacement costs.
12. SHOT LIST EXPECTATIONS
12.1 The Client is welcome to provide a requested shot list or highlight any important moments, people, or details they would like captured.
12.2 The Service Provider will make every reasonable effort to include the discussed requests where possible.
12.3 Due to the live and unpredictable nature of weddings, specific photographs, moments, angles, or scenes cannot be guaranteed.
13. CREATIVE DISCRETION
13.1 The Client acknowledges that they are booking the Service Provider based on their unique creative style and previous portfolio.
13.2 Final decisions regarding editing, colour grading, music selection, storytelling, image selection, and overall creative direction remain at the discretion of the Service Provider.
13.3 Edits will not be changed to match another photographer/videographer’s style or editing approach.
14. OVERTIME
14.1 The selected package includes the agreed number of coverage hours as stated in the Client’s quotation or booking confirmation.
14.2 Should coverage exceed the booked time by more than 15 minutes, overtime will automatically apply.
14.3 The Service Provider will make reasonable efforts to communicate with the Client, MC, wedding coordinator, or appointed representative on the wedding day should the timeline be running behind and additional coverage time be required.
14.4 Overtime is charged per team member at the following rates:
• Photographer: R1,500 per hour
• Videographer: R1,500 per hour
• Assistant / Hybrid Shooter: R1,500 per hour
14.5 Any overtime incurred will be invoiced after the wedding date.
14.6 Overtime fees must be settled before final photographs, films, galleries, or other deliverables are released.
15. ADDITIONAL SERVICE PROVIDERS & EXCLUSIVITY
By appointing JPB Media Productions CC, the Client acknowledges that the Service Provider is the official and primary photography and/or videography team for the services booked.
No additional photographers, videographers, content creators, or suppliers providing the same or similar services may be appointed without prior written approval.
This ensures clear creative direction and prevents interference, duplicated coverage, or missed moments caused by multiple teams capturing the same content.
The Service Provider cannot be held responsible for any missed shots, delays, or limitations caused by interference from any other supplier.
16. ACCEPTANCE OF TERMS AND GOVERNING LAW
By confirming a booking and making payment, the Client confirms acceptance of these Terms & Conditions.
These Terms & Conditions are governed by the laws of South Africa.
